These Terms & Conditions (“Terms”) govern the relationship between Morocco Desert Hub (“we”, “us”, “our”, “the Company”) and any person (“you”, “the Client”) who makes an enquiry, books a tour, or travels with us. Please read them carefully before confirming a booking.
By paying a deposit or confirming a booking in writing (including by email or WhatsApp), you agree to these Terms on behalf of yourself and all members of your travel party.
1. Our Services
Morocco Desert Hub is a licensed Moroccan travel agency offering private tours, desert excursions, city experiences, day trips, and custom itineraries throughout Morocco.
All tours are operated by Morocco Desert Hub directly or in partnership with vetted local service providers (drivers, licensed guides, riad and hotel partners, desert camp operators). We take responsibility for the overall quality and delivery of your tour as described at the time of booking.
2. Booking Process
2.1 Enquiry and itinerary Your tour begins with an enquiry. We will send you a tailored itinerary and a transparent, itemized quote within 24 hours. The quote is valid for 14 days from the date of issue.
2.2 Booking confirmation A booking is confirmed when:
- you have accepted the itinerary and quote in writing (email or WhatsApp), AND
- we have received your deposit (see Section 3)
Until both conditions are met, no booking exists and no accommodation, camp nights, or guides are reserved in your name.
2.3 Booking on behalf of others If you book for a group, you are the lead traveler and accept these Terms on behalf of all members of your party. You are responsible for ensuring that all travelers are aware of and agree to these Terms.
3. Payment Schedule
We use a three-stage payment structure designed to protect you:
| Stage | Amount | When |
|---|---|---|
| Deposit | 10% of total tour price | At booking confirmation — reserves your dates, accommodation, and guides |
| First payment | 50% of total tour price | On arrival in Morocco, when you meet your driver |
| Final balance | 40% of total tour price | At the end of your tour, before departure |
3.1 Accepted payment methods
- Bank transfer (IBAN details provided with your booking confirmation)
- Cash in Moroccan Dirhams (MAD), Euros (EUR), or US Dollars (USD) at current exchange rates
- Credit/debit card via our secure payment link (a processing fee may apply — stated in your quote)
3.2 Currency All prices in our quotes are stated in USD unless otherwise agreed. Cash payments on arrival may be made in MAD, EUR, or USD at the exchange rate applicable on the day.
3.3 Prices All prices are per person unless stated otherwise. Quoted prices include the items explicitly listed as “Included” in your itinerary. Items listed as “Not included” (typically lunches, personal purchases, optional entry fees, and gratuities) are your own expense.
4. Cancellation Policy
4.1 Cancellation by you
We understand that plans change. Our cancellation policy is designed to be fair to both parties:
| Notice period before tour start date | Cancellation charge |
|---|---|
| More than 30 days | Deposit only (10%) — no further charge |
| 15–30 days | 30% of total tour price |
| 7–14 days | 50% of total tour price |
| 2–6 days | 75% of total tour price |
| Less than 48 hours / no-show | 100% of total tour price |
To cancel, notify us in writing (email to info@moroccodeserthub.com or WhatsApp message) as early as possible. The cancellation date is the date we receive your written notification.
Non-refundable elements: Any costs already paid to third parties on your behalf (pre-booked riad nights, desert camp deposits, licensed guide fees) that cannot be recovered will be deducted from any refund due, regardless of the notice period.
4.2 Amendments by you
If you wish to change your tour dates, itinerary, or group size after confirmation:
- Changes requested more than 30 days before departure: we will do our best to accommodate at no charge, subject to availability
- Changes requested 7–30 days before departure: an amendment fee of $25–$50 per person may apply, depending on the change
- Changes requested less than 7 days before departure: treated as a partial cancellation; charges may apply as above
4.3 Cancellation by us
We reserve the right to cancel or modify a tour in the following circumstances:
Force majeure (see Section 9): If a tour must be cancelled due to events beyond our control (natural disasters, political unrest, government travel bans, pandemics), we will offer you:
- A full credit for future travel valid for 24 months, OR
- A refund of all amounts paid minus any non-recoverable third-party costs already incurred
Minimum group size: Some shared-departure tours require a minimum number of participants. If a shared tour does not reach the minimum, we will offer you a full refund or the option to switch to a private tour at an adjusted price.
Safety concerns: If we determine that operating a tour on specific dates would pose an unreasonable risk to your safety or that of our staff and guides, we may cancel or postpone. In this case we will notify you immediately and offer a full credit or refund.
We will never cancel a confirmed private tour for commercial reasons.
5. Changes Made by Morocco Desert Hub
We occasionally need to make minor adjustments to confirmed itineraries due to road conditions, local events, weather, accommodation availability, or guide scheduling. In these cases:
- We will notify you as soon as possible
- We will offer an equivalent or better alternative (different riad of equal or higher standard, adjusted route of comparable quality)
- You will not be charged extra for changes we initiate unless you choose a significant upgrade
If a material change significantly alters the character of your tour and you do not wish to accept the alternative, you may cancel and receive a full refund.
6. Your Responsibilities
6.1 Travel documents You are responsible for ensuring that you and all members of your party hold valid travel documents (passport, visa if required). We are not liable for any costs arising from failure to hold the correct documents.
6.2 Travel insurance We strongly recommend that all travelers purchase comprehensive travel insurance before departure, covering at minimum: trip cancellation, medical expenses, emergency evacuation, and baggage loss. For trekking tours (including Toubkal), ensure your policy covers activity at altitude (to at least 4,200 m). We are not liable for costs that adequate travel insurance would have covered.
6.3 Health and fitness You are responsible for ensuring that you and your party are in adequate health and physical condition to participate in the activities booked. Please inform us in advance of any medical conditions, dietary requirements, mobility limitations, or other considerations that may affect your tour — we will do everything we can to accommodate you. We are not liable for incidents arising from undisclosed conditions.
6.4 Conduct You and your party are expected to behave respectfully toward our staff, guides, drivers, local communities, and fellow travelers. We reserve the right to terminate the participation of any client whose behavior is unreasonably disruptive, offensive, or dangerous — without refund.
6.5 Local laws and customs You are responsible for respecting Moroccan laws and customs at all times. This includes dress codes at religious sites, alcohol regulations, and restrictions on certain substances. We will brief you on relevant customs, but compliance is your responsibility.
7. Liability
7.1 Our liability Morocco Desert Hub is liable for the proper performance of the services described in your confirmed itinerary. If a service is not delivered as described due to our fault or that of our direct partners, we will work to resolve the situation and offer appropriate compensation.
7.2 Limitations Our liability to you will not exceed the total amount you paid for your tour. We are not liable for:
- indirect or consequential losses (missed connecting flights, loss of income, etc.)
- losses caused by your own actions, omissions, or undisclosed conditions
- losses caused by third parties unconnected to your tour (e.g. airline delays, airport issues)
- losses covered by your travel insurance
7.3 Third-party services We act as an organizer and facilitator. Where we arrange services provided by independent third parties (international transport, optional activities not in your core itinerary), we do so in good faith but are not liable for the performance of those third parties beyond what is required by Moroccan law.
8. Accommodation and Transport
8.1 Accommodation All riads, hotels, and desert camps are hand-picked by Morocco Desert Hub. We describe them honestly and show real photos before booking. Star ratings, where used, reflect the local Moroccan classification system and are provided for guidance only.
8.2 Transport Private tours use air-conditioned vehicles appropriate for road conditions. Our drivers are experienced, hold valid Moroccan driving licenses, and are familiar with the routes. We are not responsible for delays caused by traffic, road closures, police checkpoints, or other external factors beyond our control.
8.3 Desert camp comfort levels Two camp tiers are offered — standard and luxury. The difference (en-suite vs shared facilities, bedding quality, level of furnishing) is described and shown in real photos at the time of booking. Both are operated hygienically and safely.
9. Force Majeure
Neither party will be liable for failure to perform obligations under these Terms if that failure is caused by circumstances genuinely beyond their reasonable control, including but not limited to: natural disasters, earthquakes, floods, fires, severe weather; war, civil unrest, terrorism, or government action; epidemic or pandemic; strikes or transport failures beyond our control.
In force majeure situations, we will notify you as soon as possible, suspend affected obligations, and work with you in good faith toward an appropriate solution (credit, rescheduling, or refund as described in Section 4.3).
10. Complaints
We genuinely want every trip to be excellent. If something is not right during your tour:
- Tell your guide or driver immediately — most issues can be resolved on the spot, and early notification gives us the best chance to fix things
- Contact us directly: WhatsApp or email info@moroccodeserthub.com
- Follow up in writing within 28 days of your tour end date with a formal complaint if the issue was not resolved to your satisfaction
We will acknowledge your complaint within 3 working days and aim to resolve it within 14 days. We take every complaint seriously and respond personally, not with template emails.
11. Reviews and Feedback
After your tour, we may ask you to leave an honest review on Google, TripAdvisor, or Trustpilot. This is always optional. We never offer incentives in exchange for positive reviews, and we never request the removal of negative reviews. Honest feedback — positive or negative — helps us improve and helps future travelers make informed decisions.
12. Privacy
We handle all personal data in accordance with our Privacy Policy, available at https://www.moroccodeserthub.com/privacy-policy/. By making a booking, you confirm that you have read and understood our Privacy Policy.
13. Intellectual Property
All content on the Morocco Desert Hub website — including text, photographs, itineraries, and guides — is the intellectual property of Morocco Desert Hub or is used with permission. It may not be reproduced, copied, or distributed without our written consent.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Kingdom of Morocco. Any dispute arising from or related to these Terms or a booking with Morocco Desert Hub shall be subject to the jurisdiction of the competent courts of Marrakech, Morocco.
For clients resident in the European Union: this clause does not affect any statutory rights you hold under EU consumer protection law, including the right to bring a claim before the courts of your country of residence.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with your confirmed itinerary and quote, constitute the entire agreement between you and Morocco Desert Hub for your tour. They supersede any prior discussions, representations, or agreements, whether oral or written.
